ACTION ALERT: PRESERVE LEXINGTON
Attend Demolition Injunction Hearing
Tuesday, July 22, 2008, 9:00 am
PRESERVE LEXINGTON will request that the circuit court grant an injunction against the demolition of buildings within the Courthouse Overlay until our appeal of the Courthouse Area Design Review Board decision is heard by the Planning Commission.
The right to appeal the decision of the CADRB is guaranteed in the law, and we believe that an injunction blocking the demolition of the buildings until our appeal is heard is only logical. Otherwise the entire appeals process is meaningless.
The Webbs and their attorneys believe otherwise. They will argue against the injunction, and if we are granted an injunction, they will ask that the judge order us to post a $25,000,000 bond to cover the "extra costs" they claim will accrue as a result of the injunction.
We need the court to understand that this is a matter of broad public concern, and so we are encouraging people to attend the hearing.
Circuit court is held in the part of the new courthouse nearest to the public library. The courtroom has not yet been designated, but will be listed on a bank of video monitors visible in the lobby of the courthouse building.
While seating is limited within the courtroom itself, a large public presence in the hall outside of the courtroom will be a tangible expression of the level of public concern about the CentrePointe project.
